These Terms & Conditions govern access to the TopDollX website and purchases made through it. By using the website, creating an account, or submitting an order, you agree to these Terms and to the policies incorporated below.

If you do not agree, do not use the website or submit an order.

1. Incorporated policies and order documents

These Terms include the following TopDollX policies:

• Shipping Policy;
• Privacy Policy;
• After-Sales Service Policy;
• Returns & Refund Policy; and
• Payment Methods.

The product page, selections placed in the cart, checkout, order confirmation, and later written order updates form the order record. That record identifies the product, configuration, price, delivery destination, and any order-specific term.

The following order of priority applies if documents conflict:

1. non-waivable law;
2. a written order-specific agreement expressly accepted by TopDollX and the customer;
3. the order confirmation and confirmed configuration;
4. these Terms and the incorporated policies; and
5. general promotional content.

2. Adults only and legal eligibility

TopDollX products and website content are intended only for adults aged 18 or older. You must also meet any higher legal-age requirement that applies where you reside or where the product will be delivered.

By using the website or ordering, you represent that:

• you are legally capable of entering into a binding contract;
• you are not purchasing for a minor;
• purchasing, importing, owning, and using the product is lawful in your jurisdiction;
• the recipient has lawfully consented to receive the shipment; and
• the information you provide is complete and accurate.

TopDollX may refuse, hold, or cancel an order when age, identity, address, sanctions, fraud, payment, import, or legal-compliance concerns cannot be resolved.

3. Website use and accounts

You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account. Notify TopDollX promptly if you believe an account or order has been accessed without authorization.

You may not:

• use the website for unlawful, fraudulent, abusive, or deceptive activity;
• impersonate another person or submit information without authority;
• attempt to bypass age, security, payment, checkout, access, or usage controls;
• introduce malware, scrape the website in a manner that disrupts service, or interfere with another user's access;
• copy, republish, sell, or exploit website content without permission; or
• use TopDollX products or services in a way that violates another person's rights or applicable law.

We may restrict or terminate access when reasonably necessary to protect customers, TopDollX, service providers, or the integrity of the website.

4. Product information

TopDollX aims to present product descriptions, measurements, materials, functions, images, and prices accurately. The product page and confirmed order summary are the source of truth for the included product and options.

The following are not included unless expressly listed:

• clothing, furniture, props, or accessories shown for styling;
• functions shown on a different model or configuration;
• third-party applications, subscriptions, or connected services; and
• customized features that were not selected and paid for.

Products may be individually finished. Minor differences caused by lighting, screen settings, makeup application, wig styling, material behavior, manufacturing tolerances, or hand finishing are not automatically defects. A difference is assessed against the confirmed model, configuration, specifications, and the reasonable appearance of an individually finished product.

Measurements and weight should be reviewed before purchase. The customer is responsible for planning safe delivery, movement, cleaning, and storage.

5. Customization

Available customization varies by model. You must review each selection before checkout. The confirmed order summary controls the final configuration.

Contact TopDollX immediately to request a change. A requested change is not accepted until TopDollX confirms it in writing. Once production or fulfillment begins:

• a change may be impossible;
• compatible changes may require additional payment;
• the production and delivery estimate may be extended; and
• the original confirmed configuration remains binding unless a revised configuration is accepted in writing.

A change in personal preference after production is not a product defect.

6. Orders and contract formation

An order submission is an offer to purchase. The automated order-received message confirms receipt but does not require TopDollX to accept an order that cannot lawfully or operationally be fulfilled.

An order is accepted when TopDollX confirms acceptance, begins allocation, customization, production, or fulfillment, or dispatches an in-stock product, whichever occurs first.

Before acceptance, TopDollX may reject or cancel an order for reasons including:

• inaccurate price or product information;
• unavailable inventory, configuration, component, or carrier service;
• failed or incomplete payment;
• suspected fraud, unauthorized payment, or sanctions concerns;
• an incomplete or undeliverable address;
• inability to lawfully ship the product; or
• an obvious website or checkout error.

If TopDollX cancels an unshipped order, the amount captured for the cancelled item will be refunded through the original payment channel. Provider and bank posting times are outside TopDollX's control.

7. Prices, taxes, and additional charges

Unless checkout states otherwise, website prices are shown in U.S. dollars (USD). The final amount due is shown before order submission and may include product price, paid custom options, shipping, discounts, and applicable tax.

Your bank, card issuer, PayPal, cryptocurrency provider, or other payment service may charge currency-conversion, cross-border, network, or account fees. Those third-party fees are not charged or controlled by TopDollX.

Import duties and customs charges are governed by the Shipping Policy and the order confirmation. A displayed shipping price does not by itself include tax, duty, brokerage, or optional carrier charges.

8. Payment

TopDollX supports:

• debit cards and other eligible bank cards;
• credit cards;
• cryptocurrency; and
• PayPal.

Only the payment methods, card brands, currencies, cryptocurrencies, and blockchain networks displayed at checkout are accepted for that transaction. Payment may be subject to provider terms, authorization, identity or fraud review, network confirmation, and regional or order-value restrictions.

Do not send payment to an address, wallet, account, or person outside the official TopDollX checkout unless TopDollX has provided and authenticated a written payment instruction for the specific order. TopDollX will never request a card password, online-banking password, cryptocurrency private key, or seed phrase.

The Payment Methods policy contains additional rules for authorization, failed payments, cryptocurrency transfers, statement descriptions, and refunds.

9. Shipping and delivery

Production, shipping, duties, address, tracking, inspection, and delivery-claim rules are stated in the Shipping Policy.

Delivery estimates are not guaranteed event dates. A delay caused by a customer-requested change, incomplete information, required confirmation, customs process, carrier event, severe weather, or another event outside reasonable control does not create an automatic right to compensation. Where applicable law requires consent to a shipping delay or a refund for unshipped merchandise, TopDollX will provide that remedy.

10. Cancellation, final sale, and claims

An order may be cancelled only if TopDollX confirms the cancellation in writing before order acceptance, allocation, customization, production, or fulfillment begins. An accepted cancellation receives a full refund of the amount captured for the cancelled item through the original payment channel.

After acceptance or production begins, and after dispatch, the order cannot be cancelled for convenience. TopDollX products are final sale for change of mind, preference, size or weight expectations, customer-selected options, and other non-quality reasons.

Final sale does not eliminate a remedy required by law for verified shipping damage, an incorrect item, a missing paid item, a manufacturing defect, or goods that materially fail to match the confirmed order. Claim deadlines, evidence requirements, exclusions, and available remedies are stated in the Returns & Refund Policy and After-Sales Service Policy.

Never return an item without written return authorization and instructions from TopDollX.

11. Care, handling, and safe use

You must follow the product-specific instructions and the TopDollX Doll Care guidance. You are responsible for safe lifting, positioning, cleaning, charging, storage, and operation.

Do not:

• lift a heavy model by the head, fingers, wrists, ankles, or another small area;
• expose electrical components to water unless the instructions expressly permit it;
• use unapproved solvents, bleach, alcohol, abrasive tools, chargers, components, or chemicals;
• attempt unauthorized electrical, structural, or software repair; or
• continue using a product that shows unsafe heat, odor, swelling, exposed wiring, smoke, structural failure, or another safety concern.

Stop use, disconnect power when safe, and contact TopDollX if a powered product presents a possible safety issue.

TopDollX products are not medical devices and are not offered as treatment for a physical or mental-health condition.

12. AI, voice, heating, movement, and connected features

Not every product includes AI, voice, heating, movement, an application, internet access, or subscription service. Only functions listed on the product page and confirmed in the order are included.

Connected features may require compatible hardware, power, Wi-Fi, Bluetooth, a mobile device, an application, an account, regional service availability, software updates, or a third-party subscription. Third-party services are governed by their own terms and privacy notices and may change, suspend, or discontinue service independently of TopDollX.

Unless the order expressly promises a specific continuing service, purchasing a physical product does not guarantee perpetual availability of a third-party application, AI model, cloud service, voice service, language, or subscription.

Do not use connected functions to submit illegal content, infringe another person's rights, impersonate a person without authorization, or disclose sensitive information you do not want processed by the applicable service.

13. Intellectual property

The TopDollX name, logos, website design, original text, graphics, photographs, videos, product presentation, and software are owned by TopDollX or used under license. They are protected by applicable intellectual-property law.

You may view and use the website for personal, non-commercial shopping. No other license is granted. Product reviews, messages, or media remain yours, but if you separately authorize TopDollX to publish them, you grant the rights described in that authorization.

14. Third-party services and links

The website may use or link to Shopify, payment providers, PayPal, cryptocurrency processors, carriers, analytics services, applications, and other third parties. A link or integration does not make TopDollX responsible for the independent content, security, availability, terms, or privacy practices of that third party.

15. Disclaimer of warranties

To the maximum extent permitted by law, the website is provided on an “as available” basis. TopDollX does not promise uninterrupted access, error-free content, or compatibility with every device, browser, application, network, or third-party service.

No separate commercial warranty applies unless it is expressly stated on the product page or order confirmation. This clause does not exclude statutory guarantees or any warranty that cannot legally be excluded.

16. Limitation of liability

Nothing in these Terms limits liability that cannot legally be limited, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable law prohibits limitation.

To the maximum extent permitted by law, TopDollX is not liable for indirect, incidental, special, punitive, or consequential loss, including lost income, lost data, missed events, or losses caused by unlawful import, unsafe handling, unauthorized repair, misuse, or an unavailable third-party service.

For a claim arising from a product or order, TopDollX's aggregate contractual liability will not exceed the amount paid for the affected product, except where applicable law requires a greater remedy.

17. Events outside reasonable control

TopDollX is not responsible for delay or failure caused by events outside reasonable control, including natural disaster, epidemic, war, civil disorder, government action, sanctions, customs hold, port or carrier disruption, labor dispute, utility or network failure, cyberattack, component shortage, or severe weather.

This clause does not remove a right to cancel delayed unshipped merchandise when applicable law requires that option.

18. Privacy

The Privacy Policy explains how TopDollX collects, uses, shares, retains, and protects personal information. Payment providers, connected services, and third-party applications may process information under their own privacy notices.

19. Changes to these Terms

TopDollX may update these Terms for future website use and future orders. The effective date at the top identifies the current version. A change does not retroactively alter an accepted order unless the customer agrees or the change is required by law.

20. Severability and no waiver

If a provision is held unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will continue in effect. Failure to enforce a provision once is not a waiver of the right to enforce it later.

21. Applicable law and disputes

Mandatory consumer-protection, privacy, product-safety, and other laws that apply to you remain in effect. These Terms do not require you to waive a right that applicable law makes non-waivable.

Before starting a formal dispute, contact TopDollX with the order number, relevant facts, and requested resolution so the matter can be reviewed. This request does not shorten or suspend any legal deadline. If the matter is not resolved, either party may use a court, regulator, payment-provider process, or other forum that has jurisdiction under applicable law.
